Understanding Dementia Waivers in California

A dementia waiver is a special authorization that allows a Residential Care Facility for the Elderly (RCFE) in California to provide enhanced care for residents with dementia and Alzheimer’s disease. Not all senior living facilities have this waiver – understanding what it means can help your family make the right choice.
What Is a Dementia Waiver?
In California, RCFEs are licensed by the Department of Social Services (DSS) Community Care Licensing Division. A standard RCFE license allows facilities to provide non-medical care including meals, housekeeping, and assistance with daily activities. However, residents with moderate to severe dementia require additional protections and specialized care.
A dementia waiver (officially called a “Dementia Care Waiver”) authorizes an RCFE to:
- Accept and retain residents with moderate to severe dementia
- Provide secured environments to prevent wandering
- Implement specialized cognitive stimulation programs
- Employ staff with advanced dementia care training
- Develop individualized care plans for cognitive decline
- Administer medications specific to dementia management
Requirements for a Dementia Waiver Facility
California law (Health and Safety Code Section 1569.698) requires dementia waiver facilities to meet strict standards:
Staff Training
All direct care staff must complete a minimum of 8 hours of dementia-specific training, plus ongoing continuing education annually.
Secured Environment
Facilities must have secured perimeters, alarmed exits, and safe outdoor spaces to prevent elopement while preserving dignity.
Care Plans
Individual care plans must be developed within 30 days of admission and updated at least annually, addressing cognitive and behavioral needs.
Activities Program
Structured daily activities designed for cognitive stimulation, including music therapy, art therapy, and sensory engagement.
